Established by the New York State Department of Environmental Conservation (NYSDEC) and administered by the Division of Environmental Remediation (DER), regulation DER-10 outlines an extensive set of requirements for brownfield remediation projects. Across 225+ pages, DER-10 outlines detailed procedures for every stage of the remediation process, from initial site assessment to monitoring, post-project cleanup, and everything in between.
Central to achieving DER-10 compliance is the creation of a Community Air Monitoring Plan (CAMP). Key CAMP requirements include the continuous monitoring of volatile organic compounds (VOCs) and PM10 at upwind and downwind locations during the earth-moving process. The difference between upwind and downwind measurements is then used to calculate the level of emissions from site activity and determine an appropriate mitigation response in the event of an exceedance.
Along with CAMP requirements, DER-10 also provides comprehensive guidance for selecting a compliance-ready air monitoring system and accurately reporting on data. Despite being enacted in New York, DER-10 has since become a benchmark piece of legislation, recognized in several states and applied to brownfield projects throughout the US.
